If you are a consumer in Germany, the German version shall prevail. Otherwise, the English version shall prevail. View German version

1) Scope

These Terms of Service apply to the use of the “mangolix” platform and the acquisition/use of credits, subscriptions, and one-time purchases (top-ups) by consumers (B2C).

2) Requirements, Account, Age Restriction

  • Use requires a user account (login via Google).
  • Use is only permitted for persons aged 18 and over.
  • You are obligated to provide truthful information and keep your login credentials confidential.

3) Service Description

mangolix offers AI-powered image tools, including:

  • Brick Figure Transformer (e.g., “Lego-Style”)
  • Image Upscaler (e.g., enlargement/enhancement)

The specific features, credit costs per operation, output formats, and limits are shown in the respective tool description on the platform.

4) Credits (Usage Unit)

  • Credits are deducted for using the tools (amount per operation as displayed).
  • Welcome Credits: Upon first registration, you receive 10 credits once.
  • Non-transferable / No Payout: Credits cannot be transferred and cannot be paid out in cash.
  • No Expiration / Rollover: Credits do not expire and can carry over across billing periods as long as your account is active.

Special Cases

  • Account Deletion by User: Credits are forfeited without replacement when you delete your account.
  • Suspension/Termination by Us: In case of justified suspension (e.g., violation of these terms), there is no entitlement to refund. In case of unjustified suspension, remaining credit value will be refunded. Refunds, if any, apply only to unused paid credits (excluding promotional/welcome credits) and are calculated based on the effective price paid for the relevant credit package.
  • Chargeback/Reversal: If a chargeback or payment reversal occurs, credited credits will be immediately deducted. We reserve the right to suspend the account until clarification. If you are responsible for an unjustified chargeback, you must reimburse our reasonable, actually incurred and documented costs, to the extent permitted by law.

5) Prices, Taxes, Payment

  • Prices are displayed at checkout (including applicable taxes, depending on country/tax rate).
  • Payment processing is handled via Stripe (subscriptions and one-time purchases).
  • We do not store complete payment data (e.g., credit card numbers); these are processed by Stripe.

6) Subscriptions

  • Subscriptions are monthly and automatically renew for another month unless cancelled.
  • Cancellation is possible at any time and takes effect at the end of the current billing period.
  • Credits included in the subscription are credited monthly (according to plan description).

7) Top-ups (One-time Purchase)

  • Top-ups are one-time purchases of credit packages.
  • After successful payment, credits are added to your account.

8) Right of Withdrawal

As a consumer, you generally have a 14-day right of withdrawal. For complete information, please see our Withdrawal Policy.

8.1 Top-ups/Credits (Digital Content)

  • 14-day withdrawal period from the date of contract conclusion.
  • The right of withdrawal expires once we begin performance before the withdrawal period ends, if you (i) expressly consent to the start of performance and (ii) acknowledge that you thereby lose your right of withdrawal.
  • We will confirm your consent and acknowledgement on a durable medium (e.g., email) and document it during checkout.

8.2 Subscriptions (Ongoing Service)

  • 14-day withdrawal period from date of contract conclusion.
  • Compensation is only owed if you expressly requested that we start providing the service during the withdrawal period.
  • If you withdraw after service has begun, you must pay compensation for services already rendered (pro-rata payment).
  • Calculation: (days used / days in the current billing period) × monthly price.
  • Credit value = monthly price / monthly included credits; consumed credits × credit value; capped at monthly price.

9) No Voluntary Refunds

  • Principle: No voluntary refunds are granted for subscriptions/top-ups/credits.
  • Statutory rights (e.g., withdrawal, warranty rights, mandatory consumer protection) remain unaffected.

10) Uploads, Content, Rights

  • You are solely responsible for content you upload (e.g., photos) and ensure you have all necessary rights (copyright, trademark, personality rights, consents).
  • Prohibited are content that is illegal, violates third-party rights, or contains sensitive third-party data without authorization.
  • Rights to Your Content: You retain all rights to your uploads.
  • Usage Right for Performance: You grant us a simple, worldwide, limited license to technically store, process, and transmit your uploads to AI/infrastructure providers as necessary to generate and deliver the requested results.

11) AI Results and Intellectual Property

  • AI results may be inaccurate or produce unexpected outcomes. We do not guarantee any specific creative/aesthetic result.
  • You are responsible for checking whether results infringe third-party rights or are suitable for your purpose.

Rights to Generated Results

  • Usage Right: You receive a simple, worldwide, temporally unlimited right to use the generated results.
  • No Exclusivity: Results may be similar to those of other users (same prompts/inputs may produce similar outputs).
  • No Guarantee of Freedom from Third-Party Rights: We do not warrant that results are free from third-party rights.
  • Responsibility: You are responsible for checking results before commercial use.

12) Digital Services – Statutory Warranty Rights & Updates

Our digital services are subject to the statutory provisions on contracts for digital products (§§ 327 ff. BGB in Germany). These terms do not limit your statutory warranty rights.

  • As a SaaS service, we provide ongoing updates during the contract period to ensure functionality and security.
  • Updates may include bug fixes, security patches, and feature improvements.
  • We will notify you of significant updates that affect the use of the service.

13) Availability, Changes

  • We strive for high availability but do not guarantee uninterrupted access.
  • We may modify, develop, or discontinue tools/features for objective reasons (e.g., technical development, security, provider changes), provided this is reasonable for you.

14) Liability

  • We are fully liable for intent and gross negligence, as well as for injury to life, body, or health.
  • For simple negligence, we are only liable for breach of essential contractual obligations (cardinal obligations) and limited to foreseeable, typical damage.
  • Liability for indirect damages (e.g., lost profits) is excluded to the extent permitted by law.
  • Liability under mandatory statutory provisions remains unaffected.

15) Moderation, Account Measures & Complaint Channel

We reserve the right to take measures against accounts that violate these terms:

Grounds for Suspension/Termination

  • Violation of these Terms of Service
  • Upload or generation of illegal content
  • Misuse of the service (e.g., automated bulk usage, circumvention of limits)
  • Fraudulent activity or payment issues

Procedure

  • Notification via email to your registered address
  • Explanation of the reason for the measure
  • Opportunity to respond before permanent termination (except in severe cases)

  • Deadline: within 14 days of notification
  • We will review and respond within a reasonable timeframe

16) Suspension/Termination

  • We may suspend or terminate accounts if there is reasonable suspicion of misuse, legal violation, or breach of these terms.
  • You may delete your account at any time (self-service, if available).

17) Applicable Law, Jurisdiction

  • German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • For consumers: Mandatory consumer protection provisions of your country of residence remain unaffected; lawsuits can generally be filed at the consumer's place of residence.
